Terms & Conditions

 

 

1. General

By accessing a website operated by START Global (including START Hack, START Summit, START St. Gallen and START Network, START ROSE and START Fellowship), a student-led club at the University of St. Gallen, you declare that you have understood and accept the following terms and conditions. START Global exclusively signs contracts, which are subject to these General Terms and Conditions. Every contractual party (including any purchaser of a ticket or registering for an event or conference organized by START Global) is agreeing to comply with and be bound by these terms and conditions. START Global reserves the right to amend and/or remove these terms and conditions as well as any other information or content of the website at any time, to any extent, and without prior notice.


2. Data Privacy Protection

2.1 The parties recognize that START Global is organizing global networking events, which live on the names of its participants. Appropriate to this fact, START Global is allowed to publish and further process retrievable public data as well as the data of every user-provided within the context of a contract (or registration). The user agrees to receive both written and electronic newsletters and other information from START Global. Cancellation of data usage is enabled through email notification (info@startglobal.org).

2.2 In order to access certain services provided by START Global (e.g. Workshops or Masterclasses during the START Summit) you may be required to upload your CV to the online event platform. By uploading your CV, you agree that START Global may share your CV with its partners.

 

3. Prices

3.1 The ticket prices on the START Global websites are inclusive of value-added tax (where applicable).

3.2 Discounted tickets are only valid in combination and/or in conjunction with an authorized identification qualifying for discount.

 

4. Events organized by START Global and/or its affiliated entities

4.1 A refund of the tickets for conferences and events is only possible up to 14 days before the event and a cancellation fee of 50% will be retained unless otherwise specified.

4.2 If the ticket is not returned within the time limit, no refund is possible. Additional claims are excluded. Thus, only the ticket price is refundable. In the event of a no-show (the ticket owner does not follow the event), there will be no refund of the ticket price.

4.3 It is possible to allocate a ticket to a third party if the ticket has been fully paid. The contact details of the new participant are to be sent to START Global immediately (info@startglobal.org), at least 14 days before the event. It is not possible to change the person or organization liable for the payment.

4.4 The tickets purchased are for your own personal use or that of your business only and may not be re-sold or transferred for commercial gain under any circumstances. Where there has been any re-sale or attempted resale of any tickets (or any other breach of this term), we reserve the right to cancel the relevant tickets with immediate effect.

4.5 If the event is being rescheduled, the tickets remain valid. Ticket holders will not be eligible for a refund. If the event is being cancelled due to unforeseen circumstances (force majeure), ticket holders will be refunded the price of the ticket against the receipt. START Global does not hold itself liable for any other expenses incurred, except in cases of intentional acts or omissions or gross negligence. START Global strives to notify its customers of force majeure cases as quickly as possible.

4.6 The order confirmation does not grant access to the virtual event. Rather it contains a passcode, which can be used to redeem the ticket on the official START Global website [insert link]. The tickets can be redeemed as from one week prior to the event.

4.7 START Global is not responsible for any loss or damage as a result of a substitution, alteration, cancellation or postponement of an event. As such, START Global reserves the right to alter or modify the advertised speakers, topics and/or formats as well as date, time and location of the events, without any liability whatsoever. Any substitutions or alterations will be updated on our web page as soon as possible.

4.8 In the case of either the event date or location (platform) being changed, in general, tickets remain valid.

 

5. Payment

5.1 START Global uses third-party providers, such as PayPal, to provide secure online payment services. The use of those services is subject to their own terms and conditions and privacy policy (provided on their own websites).

5.2 START Global may request verification of payment for the purpose of resolving possible disputes about the purchase.

 

6. Non-disclosure Agreement

„Confidential Information” shall mean any oral, written, visual, and/or other tangible forms of information, material or know-how regarding any data, process, business plan, specifications, technique, program, business information or other proprietary information relating to START Global and/or its affiliated entities, and disclosed, directly or indirectly, by START Global. Every contractual partner of START Global (including every registered user) shall hold in confidence the Confidential Information and shall not disclose such information to any third party, even under a respective secrecy agreement between the contractual partner of START Global and such third party, and shall not use such information for its own benefit or the benefit of any third party without the prior written consent of START Global.

 

7. Liability

7.1 START Global will not be liable for any loss injury or damage to any person or property howsoever caused during events. START Global will not be responsible for any tickets that are lost or stolen. Each participant must make provision for his or her own insurance.

7.2 START Global reserves the right to refuse admission to any event or conference for any behaviour, which it deems unacceptable, or for breach of the terms and conditions.

7.3 During all START Global Events, audio, picture and video recording of the attendees are free of charge and can be used unlimited spatio-temporal for press reports, advertising, posters, calendars, brochures, commercial products and manuals, and on START Global websites as well as third party websites. The rights of use by START Global can also be given to third parties both free of charge and against payment.

 

8. START Hack Specific Terms

8.1 In connection with the participation in the Event, participants shall provide accurate and complete information to START Hack as requested by START Hack.

8.2 START Hack has the right at its sole discretion to require an application and determine the participants of each Event among the applicants. Such decision by START Hack cannot be appealed. START Hack also has the right to accept a formerly rejected applicant’s participation in the Event at its sole discretion by informing such applicant thereof.

8.3 START Hack or a jury chosen by START Hack may choose a winner or winners among the work products (“Submission”) created and developed in the Event by the participants. The selection of the winner(s) of the Event shall at all times be final and cannot be appealed. If participants accept a prize for winning the Event, they are solely responsible for all applicable taxes related to accepting such prize.

8.4 Note that START Hack has the right to disqualify the participant from the Event at any time in its sole discretion for example due to inappropriate behaviour at the Event, breach of the rules of the Event or these Terms, or due to the wish of START Hack. START Hack is not responsible for any damage or inconvenience caused by the disqualification of a participant

8.5 If participating in the Event, participants must comply with the following rules:

  • They must adhere to these Terms and any additional rules stated at the beginning of the Event by START Hack;
  • They must have read and agreed to the Code of Conduct;
  • Their Submission shall not contain any viruses, Trojan horses, worms, harmful code or any other element that is malicious or damaged;
  • Their Submission shall not contain any content that violates any law or any third-party rights (including privacy and intellectual property rights), unless they are the owner of such rights or have permission or license to use such content in their Submission in the Event in accordance with these Terms.

8.6 All Submissions and other work performed at the Event remain the intellectual property of the individuals or entities that have developed them. START Hack makes no claim to any intellectual property developed during the course of the event, except as otherwise provided herein. However, Participant hereby grants START Hack and its business partners a worldwide, perpetual, irrevocable, sub-licensable and non-exclusive license to use information relating to the Submission provided by the participant on the submission platform for promotional and marketing purposes of START Hack and its business partners. Participants understand that they will not receive any royalty or compensation for this use of the Submission by START Hack.

8.7 START Hack may provide the participants of the Event with technical challenges (=cases) and resources/materials to be worked within the Event.

8.8 If the corporate partner providing the case supplies hardware for its processing, the supplied hardware must be returned at the end of the Hackathon.

8.9 The corporate partner who has provided the case processed by the participant shall receive a two-week right of first refusal for the source codes and software developed by the participants.

8.10 By participating in the Event, Participants acknowledge that the Event will be recorded for reference and similar use, and therefore they grant START Hack a worldwide, perpetual, irrevocable, sublicensable and non-exclusive license to display their work performed at the Event for promotional and marketing purposes of START Hack, for example in blog posts, online videos or case descriptions. Participants understand that they will not receive any royalty or compensation for this use of their work by START Hack.

8.11 By attending the Event, Participants consent to being filmed and/or photographed at the Event. Furthermore, Participants consents to any such footage to be published in START Hack’s and/or a third party’s, as the case may be, marketing and communication channels without the Participant’s review or approval and without compensation at any time.

 

9. Miscellaneous

9.1 Should one or more provisions of these terms and conditions be deemed invalid in whole or in part, this shall not affect the validity of the remaining provisions hereof.

9.2 These terms and conditions and all contractual relationships with START Global shall be governed exclusively by Swiss law unless otherwise contracted. The jurisdiction for all disputes arising from or in connection with this contract is St. Gallen, Switzerland. Contract language is English or German.

9.3 We may, at any time, and at our sole discretion, modify these Terms and Conditions, including our Privacy Policy, with or without notice to the User. Any such modification will be effective immediately upon public posting. Your continued use of our Service and this Site following any such modification constitutes your acceptance of these modified Terms.
